Normal people only walk from right to left?
The bottom illustration looks like a “fraud chart” produced by a State Farm “SIU” Investigation.
State Farm is now arguing before the Appellate Term that “founded belief” means that if State Farm believes the accident is staged that is good enough to deny payment and defeat a motion for summary judgment.
Look for this theory to gain traction in the App Term.
I am not paying my insurance premium this month because I have a founded belief that I am being overcharged. I expect that when this gets to the App Term they will read my affidavit which will state:
“I swear I am being overcharged.”
The App Term will then reverse the lower court ruling that held that I had no coverage for failure to pay my premiums. It will be an issue of fact.
I will pick a jury of regular citizens. On Voir Dire my main question will be “do you have auto insurance.” The jury will be totally comprised of those with auto insurance.
After my summation and the jury charge the foreperson will stand up and say “Your honor do we have to deliberate or can we just award Zuppa’s Pit his money.”
